Welcome to Catch Me If You Can ("Catch Me If You Can," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our mobile application and any related services and features (collectively, the "Services"). By accessing or using Catch Me If You Can Services (the "Service" or our "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
Please, note that this includes our Privacy Policy, Community Guidelines, and our Guidelines for Handling Harassment, Stalking, and Non-Consensual Content Sharing - Safety Tips. For this reason, it is important that you read this Agreement and these policies and procedures carefully before you create an account in our dating app.
Note: By accessing or using our services via our mobile application, you agree to and are bound by these Terms and Conditions. This agreement applies to all users of our services, regardless of whether they are registered or subscribed.

Note: We reserve the right to modify, amend, or change these Terms and Conditions at any time, subject to applicable laws. Material changes will be announced on the app with an updated effective date, and in some cases, you may be notified via email or other means. You are responsible for reviewing updates regularly. Continued use of our services signifies acceptance of changes, binding you to the updated Terms. If you disagree, discontinue use immediately. Changes to liability or dispute terms require explicit acceptance. Features in subscription plans may also change.
2.User Eligibility
To use Catch Me If You Can, you must meet specific eligibility criteria. By accessing our platform, you confirm that:
You are an individual aged 18 or older, with the legal ability to enter a binding contract.
Your location and activities comply with U.S. laws, including trade and anti-terrorism restrictions.
You are not listed on any U.S. government prohibitory list, including the U.S. Treasury Department’s list of Specially Designated Nationals or similar.
You have not been convicted of, pleaded no contest to, or committed a felony, indictable offense, sex crime, or violent crime unless granted clemency for a non-violent offense and determined not to pose a risk to others.
No legal restrictions prevent you from using our Services.
You meet our behavioral standards and do not have multiple accounts or a history of account removal without approval. For example, you are not currently in a committed relationship that would prevent you from using the App for its intended purpose.
If your eligibility changes, you must stop using the platform immediately and delete your account or our system automatically will block you. We retain the right to remove your access to our Services without warning.
Follow and review these Terms, Privacy Policy, Community Guidelines, Guidelines for Handling Harassment, Stalking, and Non-Consensual Content Sharing - Safety Tips and applicable laws. Please, be aware of any changes.

Ensure that you are using the most up-to-date version of the App.
Use the platform responsibly and ensure your actions do not disrupt its functionality.
Avoid misrepresenting your identity or engaging in harmful or illegal activities.
Do not use the Services to harass, defraud, or harm others.
Refrain from sharing Prohibited Content or engaging in unauthorized use of another user’s account.
Do not interfere with the Services’ functionality or security.
Avoid using third-party applications or creating accounts after suspension without permission.
Do not share false reports or violate intellectual property and proprietary rights.
Do not submit reports regarding another user’s behavior or content that are false, misleading, or baseless, or exploiting our reporting or appeals system in bad faith, is strictly forbidden.
Do not create a new account after your existing account has been suspended or block, unless expressly permitted by us.
Note: You are strictly prohibited from altering, adapting, sublicensing, translating, selling, reverse-engineering, decoding, decompiling, or dismantling any component of our Services, nor may you assist or enable others to engage in such activities.
Providing false information or using the platform for unlawful purposes. Sharing untrue statements, spam, or malicious code is forbidden, as is infringing on others' rights (e.g., intellectual property or privacy).
Uploading content that is offensive, harmful, abusive, illegal, violates others’ rights, harassing, or causes psychological distress. This includes obscenity, pornography, nudity, threats, discrimination, defamation, and promoting illegal or harmful activities like terrorism or self-harm. It also must not be abusive, threatening, discriminatory, or promote hatred, bigotry, racism, or sexism.
Unauthorized use of others' images, especially minors, is prohibited.
Content inconsistent with platform purposes or engaging in behaviors that damage Catch Me If You Can’s reputation, integrity or security, is also banned. Violations may lead to account suspension or termination.
Engaging in commercial activities through our platform is strictly prohibited. This includes, but is not limited to, sales, promotions, advertising, solicitation for services, involvement in arrangements like "sugar daddy" or "sugar baby" relationships, linking to external websites, or sharing premium contact numbers.
Non-compliance may result in suspension or termination of your account.
3.User Account
Account Creation:
To use certain features of the Services, you may need to create a user account ("Account").
1.You are responsible for maintaining the confidentiality of your Account information, including your password. Please, check our Privacy Policy.
2.Important: You are also responsible for all activities that occur under your Account.
User Content:
You are solely responsible for any content you upload, post, transmit, or otherwise make available through the Services ("User Content").
1.You grant Catch Me If You Can a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform your User Content in connection with the Services.
2.You agree not to upload any User Content that:
1.Respect others' contributions. The respect for this material is crucial—misusing it, such as through unauthorized duplication, harassment, or unlawful activity, could lead to severe consequences, including the termination of your account.
2.The content shared by other users on the platform belongs to them exclusively. This means you must not copy, reproduce, or exploit it for any purpose, whether personal or commercial.
3.It is important to verify information independently, as not all Member Content may be accurate or appropriate. The accuracy of such content can be verified independently, as it may include biased, incomplete, or misleading information.
4.Remember: Misusing Member Content could result in account termination. Make sure to have a positive experience for all users. Please, check our Community Guidelines.
Our Content:
Everything else you see on the platform is ours—logos, trademarks, visuals, text, content, graphics, user interfaces, sounds, artwork, images, and other intellectual property. While we grant limited rights to access and use it, it remains our property, safeguarded by intellectual property laws.

4.User Conduct; Reporting Inappropriate Content
You agree to use the Services in a respectful and responsible manner. You agree not to:
Use the Services for any unlawful purpose or to engage in any unlawful activity.
Attempt to gain unauthorized access to the Services or any related systems or networks.
Interfere with or disrupt the Services or servers or networks connected to the Services.
Harass, threaten, or intimidate other users.
Use the Services to collect personal information about other users without their consent.
Post or transmit any unsolicited or unauthorized advertising, promotional materials, or spam.
Violate any applicable laws or regulations.
Catch Me If You Can has a zero-tolerance policy for inappropriate content or conduct on its platform. Respectful interactions and adherence to community guidelines are essential to fostering a safe and welcoming environment for all users.
To help keep the community safe, we encourage users to report any misconduct. Reports can be submitted easily in our different features in the app. You have to click the Report Button and follow and answer the questions to submit it. Your vigilance and cooperation play a vital role in upholding a respectful and secure environment for everyone.
5.Privacy Policy
Your privacy is important to us. Please review our Privacy Policy in detail to understand how we collect, use on catchmeifyoucan.app, and protect your personal information. By using the Services, you consent to the collection and use of your information, like contact number, email, location, age, etc. as described in the Privacy Policy.
6.Free Trial, Subscription Plan and Benefits
Free Trial:
Catch Me If You Can offers a one-month free trial to allow you to experience the full range of features and benefits without a limited time. The free trial period starts upon account creation and will automatically expire after one month.
Subscription Options:
Catch Me If You Can provides a variety of subscription plans designed to enrich your user experience based on time. These plans grant full access to the app's features and benefits for a predetermined duration, allowing you to make the most of the platform.
Plan Options:
One-month subscription: Access for one month.
Three-month subscription: A discounted rate for three months of full access.
Twelve-month subscription: Best value for a year of uninterrupted service.
Subscription Upgrades:
If you decide to upgrade your subscription to a different plan, the change will take effect immediately. You will only be charged the prorated amount for the remaining time on your current plan, ensuring a smooth transition.
Subscription Benefits:
Unlimited Access: Enjoy unlimited access to all features, including:
1.Match: Connect with potential matches.
2.Unrestricted Messaging: Chat freely with other users.
3.Unlimited Profile Views and Matches: Explore profiles and make connections without limited time.
4.Super Likes: Stand out and increase your visibility.
5.Hunter-Prey Mode: Engage in exciting gameplay and earn points.
6.Plan & Dream Mode: Share and create your plans, dreams, and rate events you attended.
7.Subscription Purchase; Automatically Renewing Subscription and Cancellation
Purchase Restrictions:
All subscriptions must be purchased directly within the app, through your device. At this time, we do not support any other purchasing methods or platforms for subscription upgrades or renewals (there are no other subscriptions on any website or other platform, ONLY in our Catch Me If You Can app).
Remember: You can decide to purchase a subscription directly within the Catch Me If You Can app. Please follow the in-app instructions to complete your purchase.
Automatically Renewing Subscription:
Catch Me If You Can offers 3 subscription plans for purchase, each with a specific billing cycle (e.g., 3 months or 12 months). These subscriptions automatically renew at the end of the billing cycle until you cancel, ensuring uninterrupted access to premium features without limited time.
For example, if you purchase the 3-month plan and do not cancel, it will automatically renew for another 3 months at the end of the current cycle, charging you accordingly. You may cancel at any time before the renewal date to avoid the next charge.
Remember: If you wish to cancel or prevent the renewal, you must do so before the next billing cycle starts. If you cancel before the renewal date, you will still have access to your subscription benefits until the end of the current billing period.
Subscription Cancellation:
You can make purchases via internal payment methods in the app. If you cancel your subscription, you will retain access to the benefits until the end of your current subscription period.
To cancel your subscription or prevent automatic renewal, please go to the Settings section within the Catch Me If You Can App. From there, navigate to Subscription Plans and follow the instructions to manage or cancel your subscription. This cancellation process is managed directly within the app, so it is not handled through third-party services like Apple or Google Play. If you cancel, you will continue to have access to premium features until the end of your current billing cycle, after which your subscription will not renew.
For example, If you purchase a subscription plan, such as a 3-month plan, and choose to cancel before the end of the term, you will still be charged for the full duration of that plan. Canceling after one month of a 3-month subscription will result in being charged for the entire 3 months.
Please be aware that this policy applies to all subscription plans. This cancellation term is in line with applicable laws and the terms of our service.
Non-Refundable Subscriptions:
All purchases made through our Services, including subscription plans, are final and non-refundable. You understand and acknowledge that we are not obligated to provide refunds for any reason, including but not limited to, unused time or virtual items upon account termination, whether voluntary or involuntary. Once a subscription is purchased, no money or other compensation will be issued if you cancel or close your account, regardless of the remaining subscription period.
Refunds:

Refund requests must be made within the applicable legal timeframe based on your location. Refunds for purchases made via Apple ID or Google Play must be requested through the respective platforms.
8.Account Termination:
If you decide that Catch Me If You Can is no longer right for you, or if we need to terminate your account for any reason, you can easily delete your account at any time. Just log into the app, go to "Settings," select "Delete Account," and follow the prompts to complete the process. Please be aware that you are also responsible for managing or canceling any subscriptions to avoid further charges.
We reserve the right to suspend or terminate your account if we determine you have violated our Terms or engaged in inappropriate or unlawful behavior. Termination of your account does not entitle you to any refund. Your information will be managed and deleted according to our Privacy Policy.
9.No Background or Identity Verification Process
Catch Me If You Can does not perform criminal background or identity checks on its users. While we encourage respectful behavior, the responsibility for any interactions with other users rests solely with you. Always exercise caution and follow safety guidelines when communicating or meeting new individuals, whether online or in person.

10.Matching and Communication
Catch Me If You Can provides a platform for users to connect. We do not control or guarantee the compatibility of any users, the success of any communication, or the safety of any meetings that may occur as a result of using the App.
WE DO NOT FORCE\PUSH ANY USER TO DO ANYTHING. USERS HAVE COMPLETE FREEDOM TO DECIDE. WE ARE NOT RESPONSIBLE FOR ANY INTERACTIONS (MEETINGS AND ANY COMMUNICATION) OR OUTCOMES RESULTING FROM USING OUR PLATFORM.
We strongly recommend you double-check and take caution or very high caution when meeting someone you met on the App. If you feel threatened or in a dangerous situation, you must contact the police. Please exercise caution and good judgment in all communications.

11.Disclaimer of Warranties
Catch Me If You Can provides the App and all associated content "as is," without any express or implied warranties. This means that to the extent permitted by applicable law, we do not guarantee (of any kind) the App will be free of interruptions, errors, or defects, nor do we ensure the security of your data or the App’s overall performance.
Catch Me If You Can disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, non-infringement, and security. We also do not guarantee that the App will meet your specific needs or expectations. You assume all risks related to using the App, including potential issues such as viruses, security breaches, data loss, damage to your devices, or technical disruptions. Catch Me If You Can is not responsible for any such risks or damages.
We do not take responsibility for any content posted, sent, received, or acted upon by you, other users, or third parties on the App. We do not verify the identity, intentions, or authenticity of users you may interact with. Any content or materials obtained through the App are accessed at your own discretion and risk.
12.Limitation of Liability
Catch Me If You Can shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if Catch Me If You Can has been advised of the possibility of such damages), arising out of or related to:
Your use or inability to use the App
Your User Content
The conduct of any other user of the App
Any content or information obtained through the App
This applies regardless of the nature of the issue or whether we were advised of potential damages.
Catch Me If You Can's liability is limited to the maximum extent permitted by applicable law. In no event will we or our affiliates, employees, licensors, or service providers be responsible for any indirect, incidental, or consequential damages, including loss of profits, data, or goodwill, arising from your use or inability to use our services, or from any third-party content or unauthorized access.
13.Indemnification
By using the Catch Me If You Can, you agree to indemnify (compensate for harm or loss) and hold harmless the company and its affiliates from any legal claims or financial consequences arising from your actions. This ensures the company and its representatives are protected from losses due to your actions while using the service. This includes:
Violation of Terms: For example, if you misuse the app by engaging in harassment, you may be required to cover any damages caused to the company or other users.
Intellectual Property Infringement: If you upload content that violates another person’s copyright or trademark, you may be liable for any legal fees and damages.
Third-Party Claims: If someone sues the app because of your behavior, such as sharing false information about another user, you must cover the costs related to defending the lawsuit.
You agree to indemnify and defend Catch Me If You Can, its affiliates, officers, directors, and employees against any claims, demands, or legal actions arising from your use of the app. This includes, but is not limited to, situations where your actions, such as violating these Terms or harassing other users, lead to claims, damages, or costs. For example, if you share misleading information about another user or post content that infringes on someone’s rights, you will be responsible for any resulting legal fees or damages.
Please note that some jurisdictions may not allow indemnification, so parts of this section may not apply to you.
14.Termination
Catch Me If You Can reserves the right to terminate or suspend your access to the App at any time, with or without notice, for reasons including, but not limited to, violating these Terms, Privacy Policy, Community Guidelines or any action detailed in the Guidelines for Handling Harassment, Stalking, and Non-Consensual Content Sharing. This could include actions like posting harmful content, engaging in abusive behavior, or attempting to circumvent subscription payments. If a user is reported multiple times for harassment or spamming, we may suspend or terminate their access. Upon termination, you will no longer be able to use the App or access any content.
15.Community Guidelines
At Catch Me If You Can, we have established a set of community guidelines to ensure that all users can enjoy a safe and inspiring environment. These guidelines promote respectful behavior, positive interactions, and safety for everyone. We ask that you treat other members with kindness and understanding, refrain from harassment or discrimination, and engage in respectful communication.
To help maintain a positive environment, please follow these guidelines:
Respect for Others: Be kind, courteous, and treat everyone with respect. Harassment, bullying, or any discriminatory behavior is prohibited.
Safe and Positive Environment: No threats of violence or illegal activities. Respect privacy and keep conversations constructive.
Community Standards: Stay authentic, engage positively, and use the platform to connect, share dreams, and plan experiences.
Violations: Violating these guidelines can result in warnings, account suspension, or a permanent ban.

16.Safety Tips
At Catch Me If You Can, we prioritize your safety and well-being. We understand that experiencing harassment, stalking, or the sharing of non-consensual content can be distressing, and we have equipped our platform with resources to help.
If you encounter any inappropriate behavior, report it immediately using the in-app Report Button, which can be accessed in profiles, chats, plans or dreams. You also have the option to block users through our Block Feature to prevent further contact.
In Case of Emergency, Always Call 911 Immediately.
However, your personal safety is also in your hands. Here are essential guidelines to help ensure a safer experience on the app:
Online Safety:
Protect your personal information: Avoid sharing sensitive details like your full name, home address, or financial information with people you have just met online.
Never send money: Be wary of anyone who asks for money, especially if they claim to be in a crisis. Such requests are often scams, and once money is sent, it is typically non-recoverable.
Be cautious of fake profiles: Profiles that seem too good to be true or lack substantial details may not be genuine. Use reverse image searches to verify their authenticity.
Use app features: Engage via in-app messaging, photos and videos to get to know someone before meeting in person. Use the Report and Block buttons for any concerning behavior.
Trust your instincts: If something feels off, trust your gut. Discontinue contact and block the user if necessary.
In-Person Safety:
Meet in public: For your first few dates, always choose a public place. Avoid isolated or private locations.
Tell a friend: Share your plans with someone close to you, including your date’s name and location.
Stay aware: Trust your surroundings and instincts. If you ever feel unsafe, leave the situation immediately.
Guard your drink: Never leave your drink unattended to reduce the risk of tampering.
Plan your exit: Ensure you have a safe way to get home, whether it is through a ride-sharing service, public transport, or your own car.
Steps for Reporting and Seeking Help:
Use the app’s reporting tools: If you experience harassment, stalking, or other abusive behavior, report it through the Report Button found on the user’s profile or chat. Block the user to prevent further interaction.
Collect evidence: Before reporting, take screenshots and record important details such as user names, dates, and any relevant communications.
What to report: Include harassment, stalking, sexual harassment, non-consensual content sharing, and scams. These are behaviors that should be immediately reported to protect yourself and others.
Escalate to authorities (if necessary): If you feel overwhelmed, unsafe, or need further support, here are resources in the U.S.:
National Domestic Violence Hotline (800-799-SAFE): Provides confidential support and advice for those experiencing abuse.
Cyber Civil Rights Initiative (CCRI): Assistance with non-consensual content sharing or online harassment. Visit https://cybercivilrights.org.

17.Intellectual Property
All content and materials available through Catch Me If You Can, including but not limited to trademarks, logos, designs, graphics, text, and software, are protected by intellectual property laws, including copyrights, patents, and trademark rights, and are the exclusive property of Catch Me If You Can or its licensors.
You are granted no ownership rights to these materials. Unauthorized use, reproduction, or distribution of any content from the App without written consent is strictly prohibited. This includes using the content for commercial purposes or altering it in any way.
Copyright Infringement Policy:
At Catch Me If You Can, we take copyright infringement seriously and strive to address it promptly and effectively. If you believe that any content on the platform infringes upon your intellectual property rights, we ask that you notify us. The notice must include:
A signature of the authorized representative of the copyright holder.
Identification of the copyrighted work.
Identification of the infringing material.
Contact information (address, phone number, email).
A statement of good faith belief that the use is unauthorized.
A declaration under penalty of perjury that the information is accurate.

We will take necessary action, which may include terminating the accounts of repeat infringers.
18.Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms and Conditions, Privacy Policy, Community Guideline, including but not limited to any claims related to your use of the Catch Me If You Can app, shall be resolved exclusively through binding arbitration, as per the rules of the American Arbitration Association (AAA). The arbitration shall take place in New York or another mutually agreed-upon location. The arbitrator will apply the substantive law of New York, excluding its conflicts of laws provisions. Arbitration is mandatory, meaning that neither party can file a lawsuit in court.
The arbitration process ensures that disputes are resolved in a fair and efficient manner, without the need for a lengthy court case. By agreeing to these Terms, you waive your right to a trial by jury or to participate in class-action litigation. If any dispute arises, you are expected to first attempt to resolve it through informal discussions. If this is unsuccessful, the dispute will proceed to arbitration under the AAA rules.
In the U.S., Catch Me If You Can requires any disputes to be resolved through binding individual arbitration or small claims court, with a waiver of the right to a jury trial or class action. The process starts with an informal resolution attempt. If unresolved, arbitration proceeds, though claims like sexual harassment or assault may go directly to court. The venue for litigation (if arbitration is unenforceable) is Dallas County, Texas. Additionally, any changes to dispute resolution terms apply retroactively, though users can opt out within 30 days.
1.Arbitration Process: Any disputes must undergo informal resolution first. If unresolved, arbitration will be handled by NAM (National Arbitration and Mediation), under their comprehensive rules, unless a small claims court option is chosen.
2.Arbitration Procedure: A neutral arbitrator will resolve the case, with limited discovery, confidentiality protections, and the option for a hearing. The arbitrator's decision is final.
3.Mass Filings: Special rules apply for cases with multiple similar claims (Mass Filings), including bellwether proceedings to address sets of cases sequentially.
This ensures clarity about how disputes will be resolved within the platform, keeping the arbitration fair and efficient.
19.Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of laws principles. This includes, but is not limited to, any issues regarding the interpretation or enforcement of the Terms.
Any disputes, claims, or causes of action arising out of or relating to these Terms, including those arising from contractual or tort actions, shall be subject to the exclusive jurisdiction of the state and federal courts located in New York County, New York. Both parties consent to the personal jurisdiction and venue of such courts.
For subscribers residing in New York:
The Services do not guarantee any specific number of "referrals"; the functionality allows subscribers to view as many profiles as desired.
Subscribers can place their subscription on hold for up to one year by providing written notice to Catch Me If You Can Legal Team, at the specified address: Catch Me If You Can, 228 Park Ave S, PMB 794839, New York, 10003-1502, United States.

20.Entire Agreement
These Terms and Conditions constitute the entire agreement between you and Catch Me If You Can, superseding all prior or contemporaneous communications, representations, or agreements, whether oral or written. This includes, but is not limited to, any previous agreements, discussions, or understandings regarding the subject matter of these Terms.
If there were any prior emails, informal agreements, or discussions between you and Catch Me If You Can regarding services, offers, or disputes, these are nullified by this Agreement. No external representations or promises made outside of this Agreement will be binding, and any modifications or changes to these Terms must be made in writing and signed by both parties.
21.Changes to these Terms
We may revise these Terms and Conditions from time to time to reflect changes in our services, legal requirements, or business practices. Whenever we make material changes, we will notify you by posting the updated Terms on the App or sending you a notification through email or in-app alert.
For instance, if we introduce new features or update our privacy practices, we will update the Terms accordingly. Your continued use of the App after any revisions will constitute your acceptance of the new Terms, and you are encouraged to review the updated Terms regularly to stay informed of any changes.
